Questions

Can the certificate of receipt be signed electronically?

49 CFR 390.32 lets anyone required to sign a document under 49 CFR Parts 300 to 399 use an electronic signature. The record must be retainable, accurately reproducible on request, and include proof of consent to electronic records under 15 U.S.C. 7001(c).

How long are signed receipts kept?

Education and training records, which include the signed receipt, are kept while the driver performs the functions that require them and for two years after. They must be available within two business days of an FMCSA request.

Can the policy include company rules beyond Part 382?

Yes. Section 382.601(c) allows additional employer policies, provided they are clearly and obviously described as based on the employer's independent authority.

What did the June 2026 Part 40 rule change?

It requires a directly observed urine collection where an oral fluid test is required but oral fluid testing is not yet available, and it updated terminology in the procedures. The September 2025 proposal to add fentanyl to the panel had no final rule in the Federal Register as of October 18, 2026.

Is recurrent supervisor training required?

Part 382 sets a one-time minimum of 60 minutes on alcohol misuse and 60 minutes on controlled substances. Recurrent training for supervisors is not required.
